CLEAR provides administrative and technological services. We are not a medical provider and do not provide medical advice, diagnosis, or treatment. The content on our platform is for informational purposes only. Always seek the advice of your physician or other qualified health provider with any questions you may have regarding a medical condition. Never disregard professional medical advice or delay in seeking it because of something you have read on our platform.
We take your privacy seriously. Your personal and health information is protected under the Health Insurance Portability and Accountability Act (HIPAA) and our comprehensive Privacy Policy. We implement industry-standard administrative, physical, and technical safeguards to protect the confidentiality, integrity, and availability of your data. We strive to maintain the availability of our Services 24 hours a day, 7 days a week. However, there may be times when the Services are unavailable due to maintenance, upgrades, emergency repairs, or telecommunications failures. Payment for services, including lab tests and phlebotomy fees, is generally required at the time of booking or service rendering, unless valid insurance information is provided and verified. You authorize us to charge your chosen payment method for all fees incurred. You are responsible for any fees not covered by your insurance provider.
Appointments: You may cancel or reschedule a mobile phlebotomy appointment up to 24 hours before the scheduled time for a full refund. Cancellations made within 24 hours of the appointment time may be subject to a cancellation fee.
Lab Orders: Lab test orders can be cancelled for a full refund if the requisition has not been used at a patient service center or mobile visit. Once a sample has been collected, orders are non-refundable.
To the fullest extent permitted by law, CLEAR shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your access to or use of or inability to access or use the Services; (b) any conduct or content of any third party on the Services; or (c) unauthorized access, use, or alteration of your transmissions or content. Our aggregate liability for all claims relating to the Services shall not exceed the amount paid by you to CLEAR for the specific service giving rise to the claim.
We reserve the right to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
These Terms shall be governed and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.
